Press Release - Plea of Kyle D. Smith
PRESS RELEASE

Sussex County Prosecutor Francis A. Koch announced the entry of a guilty plea to an accusation before the Honorable Louis S. Sceusi, J.S.C. at the Sussex County Virtual Courtroom in Newton on June 17, 2021 by Kyle D. Smith.
Smith, age 22, of Newton, pled guilty to Assault by Auto, a crime of the third degree and Motor Vehicle Summons Driving While Under the Influence. Sentencing is presently scheduled for July 14, 2021 before the Honorable Louis S. Sceusi, J.S.C. for the Assault by Auto charge. He was sentenced during his plea for his DWI charge to seven (7) month loss of his driver’s license, seven (7) month Interlock program and he must pay $689.00 in court fines and fees.
The defendant admitted he was driving after using Marijuana. He crossed the over the center line into oncoming traffic on Route 206, hitting the oncoming vehicle head-on, causing serious injuries to the other driver.
Smith was represented by Howard Bailey, Esq., and the State was represented by Assistant Prosecutor Brent M. Rafuse.
