Sussex County Prosecutor Francis A. Koch announced the sentencing of David M. Utter, who appeared before the Honorable Michael C. Gaus, J.S.C. at the Sussex County Virtual Courtroom in Newton on March 4, 2022.
Utter, age 32, of Port Jervis, NY, was sentenced to two years non-custodial probation with credit for four days jail already served. He was ordered to submit to a substance abuse evaluation and follow any and all recommendations, made for same, and pay $2,083.00 in fees including motor vehicle fines. His driving privileges were ordered suspended for one year and seven months.
He pled guilty on December 6, 2021 to Possession of a Controlled Dangerous Substance, a crime of the third degree and on March 4, 2022 he pled guilty to the motor vehicle offenses of driving under the influence and failing to have liability insurance.
The defendant drove his vehicle recklessly while under the influence in Montague Township on July 17, 2020.
Utter was represented by Bruce Farrier, Esq. and the State was represented by Assistant Prosecutor Sally Anne Monkemeier.
